driving while smoking marijuana subjects you to penalties for DUI as well as possession of marijuana - Possession of marijuana is defined in code section 18.2-250.1. In Virginia, a first offense for possession of marijuana is an unclassified misdemeanor with a maximum 30 day jail sentence.

Is any DUI penalty in addition to the possible 30 days for marijuana possesion? Is the penalty different for the driver and the passenger? CFF
