driving while smoking marijuana subjects you to penalties for DUI as well as possession of marijuana - Possession of marijuana is defined in code section 18.2-250.1. In Virginia, a first offense for possession of marijuana is an unclassified misdemeanor with a maximum 30 day jail sentence.
